Our privacy policy was certified by the non-profit organization Ag Data Transparent on June 9, 2019.
Logiag (hereinafter sometimes referred to as “we”, “us”, “our”) provides agri-environmental consulting services (hereinafter referred to as “Service”).
The following are our policies regarding the collection, use and disclosure of agronomic and personal data when you use our Service.
Logiag’s privacy policy complies with the Act respecting the protection of personal information in the private sector (Quebec).
Logiag offers a personalized service adapted to the needs of each individual. Furthermore, our company’s commitment is to provide, every day and in every way, an excellent service to each client. We use your data to provide and improve the service.
Another key element of our quality service is the protection of the Personal Data of each customer (including our future customers). We have a professional and legal obligation to respect the confidentiality of all Personal Data entrusted to us. That is why we have established this Privacy Policy.
By using the Service, you consent to the collection and use of information in accordance with this policy.
1. – Definitions
a) Service
Service means the services provided to customers directly by Logiag or through its partners or service providers.
b) Personal Data
Personal Data means data about a living individual who can be identified from such data (or from such data and other information in our possession or likely to come into our possession) and/or a legal person (the farm).
When you use our Service, we may ask you to provide certain personally identifiable information that can be used to contact or identify you (hereinafter referred to as “Personal Data”). Nominative personal information may include, but is not limited to:
- First and last name;
- Email address;
- Telephone number; and
- Address, city, province (or state), country, postal (or zip) code.
2. – Use of Personal Data
Logiag endeavours to process Personal Data in compliance with applicable laws and regulations, more specifically in compliance with the Act respecting the protection of personal information in the private sector (Quebec).
Logiag uses Personal Data for the following purposes, which could reasonably be expected, namely:
- To manage and improve its communications with the customer;
- To communicate with its customers to obtain feedback on the services provided or for market research or other purposes; and
- To provide information related to new products, services or other information that may be of interest to you. Other uses may also be added, with your consent, unless such uses are permitted or required by law.
3. – Disclosure of Personal Data to Third Parties
Other than for the purpose of responding to your requests or inquiries, we will only disclose your Personal Data to Third Parties with your express consent.
4. – Disclosure of Personal Data in response to legal requirements
Logiag may disclose your Personal Data if it believes, in good faith, that it is necessary to:
- Fulfill a legal obligation;
- Protect and defend the rights or property of Logiag;
- Prevent or investigate potential wrongdoing (such as fraud) in connection with the Service;
- To ensure the personal safety of users of the Service or the public; and
- To protect against claims for damages, punitive damages, moral damages or otherwise, as well as any other form of claim or demand that may arise from its liability.
5. – Agronomic data
In order to carry out a mandate you have given us, we may collect data on the following aspects of this non-exhaustive list, namely a) soils, including soil analysis, b) crop plots, including tillage, drainage status and soil conservation and erosion control structures, topography, c) crops, including seed varieties, yields, diseases, fertilizer application and pest control products, d) livestock, including type and number, farm fertilizers, e) watersheds and relevant geospatial information. All data required for service delivery (for example, AEFP production) is stored and tracked in Logiag systems.
a) Retention of agronomic and geographic location data
We are the only ones who keep and have access to the data collected. We only have access to data that you have voluntarily provided to us and to data that is available from legal and legitimate sources (for example, the Ministère de l’Environnement, de la Lutte contre les changements climatiques, de la Faune et des Parcs discloses the list of watercourses in Quebec in electronic form). We will not sell or rent this data to anyone; it remains your property.
We will not be able to provide you with the dataset you have provided, in the original format or in any other form, nor will we be able to delete it from our database.
In addition, when you use one of our mobile device applications, we may use GPS (or similar) technology to determine your geographic location on a map, for the same purposes listed above.
b) Use of agronomic and location data
Logiag uses the collected agronomic and location data for a variety of purposes that could reasonably be expected under the circumstances, including:
- Providing and maintaining our Service;
- Compiling statistical analyses;
- Communicating changes to our Service to you;
- Allowing you to use the interactive features of our Service when you want to, if applicable;
- Providing customer support;
- Having some control over the use of our Service; and
- Detecting, preventing and fixing technical problems.
c) Disclosure of agronomic and geographic location data to Third Parties
We may share your agronomic and location data with Third Parties for the purpose of responding to your requests or questions. We will not disclose your agronomic data to Third Parties without your express consent, unless it is for the purpose of responding to your requests or questions.
With respect to geographic location, if you do not want your geographic location to be known by any of our mobile device applications, we suggest that you do not allow your location to be identified within the general settings or preferences of your mobile device, or within the application itself, accordingly.
6. – Data Accuracy
We compile all data in our possession in the most accurate, complete and up-to-date manner possible for the purposes set forth. We also rely on you to provide us with your Personal Data, agronomic data and geographical location data that are complete and up-to-date. To this end, we invite you to contact us as soon as possible (our contact information is indicated at the end of this page).
7. – Data security
The security of your data is important to us. However, please keep in mind that no method of transmitting data over the Internet or method of electronic storage is completely infallible. While we strive to use commercially acceptable methods to protect your Personal Data, as well as your agronomic and geographic location data, we cannot guarantee their absolute security.
Logiag will notify you as soon as it realizes that an unauthorized Third Party has accessed Logiag’s system and confidential data, contracts, products, reports and other data collected by Logiag.
8. – Service Providers
We may use third party companies and individuals to facilitate the provision of our Service (hereinafter referred to as “Service Providers”), perform the Service on our behalf, perform services related to the Service, or assist us in analyzing how our Service is used.
These Third Parties only have access to your Personal Data to perform these tasks on our behalf and are strictly prohibited from sharing or using it for any other purpose.
We will only share your data with third party companies after we have obtained your written consent to do so.
9. – Changes to this Privacy Policy
We reserve the right to update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on our web page.
Before the change takes effect, we will notify you by email and/or mail and update the effective date at the top of this Privacy Policy.
We recommend that you review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when posted on this page.
